1. Service Inclusions
Your WordPress hosting package includes:
1.1 General Maintenance
- Text updates, image changes, and content edits
- Resolution timeframe: 24-72 hours
- No additional invoicing for routine updates
- Structural changes (new pages, functionality additions, design modifications) are quoted separately
1.2 Performance Management
- Loading speed monitoring
- Image delivery optimisation
- Regular performance checks
1.3 Security & Technical Services
- Hack protection and security monitoring
- SSL certificate installation and management
- Monthly automated backups (see Section 5 for backup policy)
- WordPress core updates
- Plugin updates and maintenance
- Access to advanced paid plugins (no licensing fees charged to Client)
1.4 Reporting & Support
- Monthly analytics reports
- Expert New Zealand-based support during business hours
2. Service Limitations
The following are NOT included in standard hosting maintenance and will be quoted separately:
- Creation of new pages or sections
- Design modifications or layout changes
- New functionality or feature development
- Major content restructuring
- Custom development work
- Third-party integrations
3. Lead Forms & Contact Form Submissions
3.1 Form Testing
All lead forms and contact forms on your website will be tested when hosting services commence to ensure they are functioning correctly.
3.2 Client Responsibility for Monitoring
It is your responsibility to monitor that lead forms are working correctly and that form submissions are being received. You must notify Four Stripes immediately if you suspect that lead forms are not delivering submissions to you.
3.3 Protection of Lead Data
Form submissions contain potentially sensitive customer information. By agreeing to these terms, you acknowledge that:
- Once a form is submitted on your website, your company's privacy policy governs the handling of that data
- You are responsible for compliance with the Privacy Act 2020 regarding data collected through your website forms
- Four Stripes stores form submission data in the website database as a technical function only
3.4 Four Stripes Access to Form Data
Four Stripes will only access lead form submissions stored in the website database when:
- Diagnosing technical issues with form delivery at your request
- Troubleshooting why forms are not being sent to you
- Performing necessary technical maintenance
We will not access, read, or use form submission data for any other purpose.
3.5 Data Security
While we implement reasonable security measures, you acknowledge that you are responsible for:
- Regularly checking that forms are functioning
- Promptly downloading or backing up leads from your email or CRM systems
- Notifying us of any technical issues within a reasonable timeframe
Four Stripes is not liable for lost leads or business opportunities resulting from form malfunctions that were not reported to us in a timely manner.
4. Payment Terms
4.1 Billing Structure
Our hosting operates on a prepaid basis: you pay for the period, we host for the period.
- Monthly Payments: Pay monthly in advance. Hosting continues for the month paid.
- Annual Payments: Pay for 6 or 12 months in advance. Hosting continues from the invoice date until the next renewal date.
4.2 Payment Due Dates
All invoices must be paid by the due date specified on the invoice. Invoices are sent well in advance of the renewal date.
4.3 No Refunds
Hosting fees are non-refundable once the service period has commenced. This does not affect your rights under the Consumer Guarantees Act 1993.
5. Website Backups
5.1 Backup Frequency
We perform automated backups of your website once per month.
5.2 Backup Retention
Four Stripes retains only ONE backup at any given time—the most recent backup. If you have hosted with us for four months, we will have one backup (the latest), not four separate backups.
5.3 Backup Limitations
- Backups are provided as a courtesy and disaster recovery measure
- We recommend clients maintain their own independent backups
- Four Stripes is not liable for any data loss that occurs between backup intervals
- Backup restoration may incur additional fees if extensive work is required
6. SSL Certificates
SSL certificates are included in your hosting fees and will be reactivated with every paid invoice. SSL certificates will be deactivated if hosting payments become overdue.
7. Website Access & Third-Party Changes
7.1 Granting Access to Others
We are happy to provide website access credentials to additional users you authorise (such as your staff, contractors, or other developers).
7.2 Third-Party Modifications
If an authorised third-party user makes changes to your website that require Four Stripes to fix, undo, or resolve, you will be charged our standard hourly rate for the time required to address these issues. This includes but is not limited to:
- Broken functionality caused by third-party edits
- Plugin conflicts introduced by others
- Theme or design issues created by unauthorised modifications
- Security vulnerabilities introduced by third parties
7.3 Client Responsibility
You are responsible for any changes made by users you grant access to. We recommend limiting administrative access and informing any third parties of these terms.
8. Overdue Hosting Payments
8.1 Reminder Process
If your hosting renewal invoice is not paid by the due date, you will receive three invoice reminders sent three days apart.
8.2 Service Suspension
If payment is not received after the third reminder, Four Stripes will suspend your website hosting service. The website will remain offline until the outstanding invoice is paid in full.
8.3 Backup Deletion
Should the hosting invoice remain overdue for more than 14 days from the due date, all website backups stored by Four Stripes will be permanently deleted.
8.4 Limitation of Liability
Four Stripes will not be held responsible for:
- Loss of website files or data due to non-payment
- Loss of sales, revenue, or business opportunities during suspension
- Any damages arising from service suspension due to overdue invoices
8.5 Payment Arrangement Exception
This policy may be waived if prior arrangements have been made in writing with Four Stripes, clearly noting why the invoice cannot be paid by the due date and confirming an alternative payment date.
9. Domain Renewal
9.1 Critical Importance
Domain renewal invoices are time-sensitive and must be paid before the domain expiration date. Domain renewals are handled by third-party registrars and follow strict timelines beyond our control.
9.2 Renewal Notices
Four Stripes will send domain renewal invoices well in advance of the expiration date. It is your responsibility to ensure payment is made on time.
9.3 Consequences of Non-Payment
If a domain renewal invoice is not paid by the due date:
- Your domain may be released by the registrar
- Your website will become inaccessible
- ALL website files and backup files will be permanently deleted 14 days after the domain expiration date
9.4 No Liability for Domain Expiration
Four Stripes will not be held liable for:
- Loss of domain ownership
- Loss of website files, data, or backups
- Loss of sales, revenue, or business opportunities
- Any damages arising from the
- domain expiration due to non-payment
9.5 Website Rebuild Following Data Loss
In the event that website files are lost, removed, or deleted due to overdue domain renewal payments, Four Stripes reserves the right to invoice you for the full cost of rebuilding your website.
This rebuild will:
- Replicate the website prior to data loss as closely as possible
- NOT include new features, functions, pages, or design improvements
- Be charged at our current website development rates
- Require full payment before work commences
10. Client Responsibilities
You agree to:
- Maintain accurate contact information for invoice delivery
- Pay all invoices by their due dates
- Notify us immediately of any security concerns or website issues
- Maintain your own independent backups if business-critical
- Ensure any third parties granted access understand these terms
- Comply with all applicable New Zealand laws regarding website content
11. Prohibited Content & Activities
You may not use our hosting services to:
- Host illegal content under New Zealand law
- Distribute malware, viruses, or malicious code
- Conduct phishing, spamming, or fraudulent activities
- Host content that infringes intellectual property rights
- Engage in activities that compromise server security or performance
- Host excessively high-traffic sites without prior arrangement
Four Stripes reserves the right to suspend services if prohibited content or activities are detected immediately.
12. Service Availability
12.1 Uptime Commitment
While we strive for maximum uptime, we do not guarantee 100% service availability. Planned maintenance will be scheduled during off-peak hours where possible.
12.2 Force Majeure
Four Stripes is not liable for service interruptions caused by events beyond our reasonable control, including but not limited to:
- Internet service provider outages
- Server hardware failures
- Natural disasters
- Cyber attacks
- Government actions
13. Termination & Cancellation
13.1 Termination by Client
You may terminate hosting services at any time by providing written notice. No refunds will be issued for unused portions of prepaid hosting periods.
13.2 Licensed Plugins & Themes Upon Cancellation
All premium plugins and themes provided during your hosting with Four Stripes are licensed to Four Stripes, not to you individually. Upon cancellation or termination of hosting services:
- Premium plugins will NOT be removed from your website files
- Premium themes will NOT be removed from your website files
- You will be responsible for obtaining your own licences for these plugins and themes at your own cost
- Alternatively, you must replace these premium plugins/themes with free alternatives at your own cost
- Four Stripes is not responsible for any loss of functionality if you choose not to license or replace these components
13.3 Termination by Four Stripes
We reserve the right to terminate services immediately if:
- You breach these Terms and Conditions
- Your website hosts prohibited content
- Payment remains overdue beyond the periods specified in Sections 8 and 9
- Your website compromises server security or performance
13.4 Data Retrieval Upon Termination
Upon termination, you have 14 days to request a copy of your website files and database. After 14 days, all files will be permanently deleted.
14. Intellectual Property
14.1 Website Ownership
You retain ownership of all content, images, text, and materials you provide for your website.
14.2 Website Files
Upon full payment of all outstanding invoices, you own the website files, design, and code (excluding third-party themes, plugins, or components governed by their own licences).
14.3 Four Stripes Property
Four Stripes retains ownership of our proprietary processes, methodologies, and any pre-existing intellectual property used in providing services.
15. Limitation of Liability
To the maximum extent permitted by New Zealand law:
Four Stripes' total liability for any claim arising from hosting services shall not exceed the total amount paid by you for hosting services in the 12 months preceding the claim.
Four Stripes is not liable for:
- Indirect, consequential, or incidental damages
- Loss of profits, revenue, or business opportunities
- Loss of data (except as required by the Consumer Guarantees Act 1993)
- Damages arising from your failure to maintain independent backups
- Issues caused by third-party modifications
- Domain loss due to non-payment
16. Consumer Guarantees Act 1993
Nothing in these Terms and Conditions limits or excludes any rights you have under the Consumer Guarantees Act 1993 or other applicable New Zealand consumer protection legislation. If you are acquiring hosting services for business purposes, you acknowledge that the Consumer Guarantees Act 1993 does not apply to the supply of these services.
17. Changes to Terms
Four Stripes reserves the right to modify these Terms and Conditions at any time. Changes will be notified via email at least 30 days before taking effect. Continued use of services after changes take effect constitutes acceptance of the modified terms.
